JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 23-02-2022 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is apprehending his arrest in a case registered in connection with Bisfi P.S.Case No. 314 of 2019 for the offences punishable under Sections 341, 323, 324, 353, 504, 506/34 of the Indian Penal Code.

As per prosecution, all the F.I.R named accused persons including this petitioner entered into the school and abusing, caught Shambhu Yadav and assaulted with fat, fist and pressed his neck.

Learned counsel for the petitioner submits that no overt act has been attributed against the petitioner. The injury sustained by Shambhu Yadav is simple in nature. Similarly situated co-accused persons have already been granted

Patna High Court CR. MISC. No.32453 of 2021(3) dt.23-02-2022 2/2 anticipatory bail by the trial court in A.B.P No. 190 of 2020 vide order dated 18.03.2020.

Learned Additional Public Prosecutor opposes the bail prayer of the petitioner.

Considering the facts and circumstance of the case as well as submission of the parties, let the petitioner in the event of his arrest or surrender before the Court Below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhubani in connection with Bisfi P.S Case No. 314 of 2019 subject to the conditions as laid down under Section 438(2) of the Cr.P.C (Sunil Kumar Panwar, J) N.K/- U T
