At an initial stage Complaint Case No.1742/2016 was filed which was sent to the local police for registration and investigation under Section 156(3) of the Cr.P.C. wherein the complainant had shown his grievances against the accused persons who, by creating forged and fabricated document (deed of agreement) intend to defeat his interest in his ancestral property. Learned counsel for the petitioners submit that no such document has been created by him nor the petitioners intend to take any kind of benefit on the basis of the so-called agreement, consequent thereupon informant has nothing to apprehend at the ends of the petitioners.
Learned Additional Public Prosecutor opposed the prayer.
Accepting the submission having been at the end of the
Patna High Court Cr.Misc. No.50597 of 2016 (2) dt.16-12-2016 petitioners who are under custody since 03.09.2016, petitioner Om Prakash Thakur @ Butai Thakur, Rakesh Ranjan @ Pappu each are directed to be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur in connection with Muzaffarpur Sadar P.S.
