The petitioner seeks bail in Jagdishpur P.S. Case No. 275 of 2015, registered for the offence punishable under Section 394 of the Indian Penal Code.

The informant alleged that while he was coming to Ara by his motorcycle and reached near Gramin Bank, Kohra four persons came in front of the motorcycle of the informant and they snatched Rs. 35000/- and a mobile phone from possession of the informant. The informant identified the petitioner among the criminals.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in the case on account of enmity. Similarly situated co-accused Ranjit Singh @ Pintoo

Patna High Court Cr.Misc. No.42380 of 2016 (3) dt.06-12-2016 2/2 Singh has already been enlarged on bail vide order dated 08.04.2016 passed in Cr. Misc. No. 14601 of 2016, but it appears that the case of the petitioner is quite different as the informant identified the petitioner out of four criminals who looted his money and mobile phone and Rs. 5000/- was also recovered from possession of the petitioner.

Considering the facts aforesaid, I am not inclined to enlarge the petitioner above named on bail. Accordingly, the same is rejected.
