The petitioners apprehend their arrest in Supaul P.S. Case No. 413 of 2016 instituted for the offence under Sections 147, 148, 149, 323, 307 and 504 of the Indian Penal Code. As per allegation in the written report, petitioner No. 2 assaulted the daughter-in-law of the informant Runa Devi. There is no specific allegation of overt act against the petitioner No. 1.

Case diary has been received.

The learned A.P.P. after looking into the injury report of Runa Devi available in the case diary has submitted that she sustained simple injury caused by hard and blunt substance.

Patna High Court Cr.Misc. No.9606 of 2017 (3) dt.24-03-2017 2/2 Injury No.1 was lacerated wound 1 1⁄2" x 1⁄2" skin deep in right side of head whereas injury No. 2 was swelling 2" x 1" right side of back. As such from the injury report, it appears that there is no repetition of blow on the person of the injured. From the written report itself it appears that occurrence took place on account of land dispute between the parties.

Considering the facts and circumstances of the case, prayer for anticipatory bail of the petitioners is allowed. In the event of surrender/arrest of the petitioners, named above, within six weeks from today, in connection with Supaul P.S. Case No. 413 of 2016, they shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Supaul, subject to the conditions as laid down under Section 438 (2) Cr. P.C.
