ANJANA MISHRA ORAL ORDER 24-01-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 15.09.2018 in connection with Bihar P.S. Case No.191 of 2018 (Special (Excise) Case No.484 of 2018) registered for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioner submits that the recovery alleged to have been made is not from the conscious possession of the petitioner and that he has already been in jail custody for over four months.

Considering the aforementioned facts and circumstances and the recovery was not from his conscious possession, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with
