JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 15-12-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor.

Some persons were engaged in removing packets lying by the side of railway track which the informant, a R.P.F. Personnel perceived and on chase, petitioner along with Bittu Kumar was apprehended while remaining managed to escape whose identity has also been disclosed.

Contention on behalf of the petitioner is that nothing has been removed by the petitioner. Apart from this, petitioner has got no criminal antecedent and is under custody since 12.05.2016. On the other hand, learned Additional Public Prosecutor opposed the prayer, but fairly concedes that there was an attempt at the relevant moment to remove bundles

Patna High Court Cr.Misc. No.48975 of 2016 (02) dt.15-12-2016 unfortunately seen by the prosecution party and was apprehended. In the aforesaid facts and circumstances of the case, petitioner, Sikandra Sah @ Sikandra Kumar is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Railway Judicial Magistrate, Sonepur, Saran at Chapra in connection with Muzaffarpur R.P.F. P. S. Case no.03 of 2016.
