JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 28-07-2021 Heard learned counsel for the petitioner and learned APP for the State through virtual Court proceedings. Learned counsel for the petitioner undertakes to remove the defects within four weeks of resumption of normal court proceeding. In the eventuality of non-removal of defects within undertaken period, the office will place the matter before the Bench.
This modification application has been filed to modify the order dated 27.02.2020 passed in Cr. Misc. No.2271 of 2020 by which six persons including this petitioner were allowed anticipatory bail with certain condition as set out therein. Earlier a modification petition vide Cr. Misc. No.7442/2021 was filed on behalf of the petitioner for correction of parentage, age etc.
Patna High Court CR. MISC. No.33518 of 2021(2) dt.28-07-2021 2/2 and also for extension of time which was allowed vide order dated 01.02.2021 but only because the word, 'surrender' was not typed therein the learned Court below misunderstood the same as a result of which time allowed to surrender expired. In that view of the matter, this application is allowed and the order dated 27.02.2020 passed in Cr. Misc. No.2271 of 2020 is modified only to the extent that the petitioner is granted further four weeks time from today to surrender before the learned Court below.
