The application is for grant of bail for the offence under Sections 364, 365, 406 and 34 of the Indian Penal Code. It is submitted on behalf of the petitioner that the petitioner is not named in the FIR and his name transpired during the course of investigation in confessional statement of the coaccused but nothing has been recovered from the possession of the petitioner Heard learned A.P.P. also, who has pointed out that on the basis of confessional statement of the co-accused, name of the petitioner appeared and it is alleged that he supplies arms and there is mobile details also with regard to this petitioner. Having heard both sides and considering the fact that

No.47834 of 2016 (3) dt.21-12-2016 2/2 though the name of the petitioner transpired in the confessional statement of the co-accused, there is nothing against him and the charge sheet has been submitted in this case. Further there is no criminal antecedent of the petitioner, let the petitioner be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of CJM, Araria in connection with Farbesganj P.S. Case No.131 of 2016.
