The petitioner seeks regular bail in connection with Muffasil (Lakhaura) P.S. Case No. 511 of 2017 for the offenses punishable under Sections 420, 379, 342, 307, 120B/34 of the Indian Penal Code.

Allegation is that the accused persons including the petitioner assaulted the informant and took away Scorpio of the informant.

It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. Rest of the offences are triable by the Magistrate. It is lastly submitted that similarly situated co-accused person, namely, Naushad Alam has already been granted bail by an order dated 01.11.2018 passed in Criminal Misc. 53959 of 2018. On behalf of the State, it is submitted that the petitioner is named in the complaint case/F.I.R. Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Muffasil (Lakhaura) P.S. Case No. 511 of 2017.
