The petitioner seeks bail in Sessions Trial No. 166 of 2019 arising out of Paliganj P.S. Case No. 286 of 2018, instituted for the offence under Section(s) 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

Counsel for the petitioner submits that petitioner is in custody since 20.09.2018. He is not named in the written report. The name of petitioner has come in the confessional statement of co-accused Ranjeet Kumar. The First Information Report has been lodged against unknown.

It is alleged in the written report that brother of the informant who is private agent in Post Office of Purani Bazar, Paliganj, was returning back to his house after collecting

No.20135 of 2019(2) dt.02-04-2019 2/2 money and reached near the house of Chitaranjan Chaudhary, 3-4 persons came on Motorcycle and one of them started making firing from his pistol upon his brother, on account of which, he died on the spot. The accused persons snatched the bag of brother of the informant containing cash. Petitioner is in custody since 20.9.2018.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge-1st, Danapur, Distt. Patna, in connection with Sessions Trial No. 166 of 2019 arising out of Paliganj P.S.
