JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-12-2016 Heard learned counsel for the petitioners and learned counsel appearing on behalf of the State.

This is an application for grant of regular bail for offences punishable under Sections 364, 365, 406, 302, 201/34 of the Indian Penal Code.

It has been submitted on behalf of the petitioners that they have not been named in the First Information Report but later on during the course of investigation, their names surfaced only on the basis of confession made by a co-accused of this case and also nothing has been recovered from the possession of the petitioners. Learned A.P.P. for the State, also could not controvert this fact that save and except the confessional statement of the coaccused, there is nothing against these petitioners.

No.54143 of 2016 (2) dt.22-12-2016 2/2 Having heard both sides and in view of the fact, that there is no direct allegation against these petitioners, their names surfaced only on the basis of confessional statement of co-accused and the petitioners have been in judicial custody since 25.08.2016, let the petitioners above named, be released on bail on furnishing bail bonds of Rs. 10,000 (Rs. Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Araria, in connection with Forbisganj P.S. Case No. 131 of 2016.
