JUSTICE SANDEEP KUMAR ORAL ORDER 17-05-2023 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. The petitioner seeks regular bail in connection with Bhagwanpur P.S. Case No. 231 of 2018, registered for the offence punishable under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016.
Learned counsel for the petitioner submits that the petitioner is innocent and falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. Petitioner is in custody since 04.04.2021. Petitioner has not been Put on T.I.P.
Learned APP has vehemently opposed the prayer for bail.
Considering the nature of allegation levelled against the petitioner, his period of custody, this application is allowed.

No.22767 of 2023(2) dt.17-05-2023 2/2 Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Vaishali at Hajipur in connection with Bhagwanpur P.S. Case NO. 231/2018.
This is also subject to the conditions that (I) the petitioner would cooperate in the proceeding of the court below. In the event of failure to appear on two consecutive dates, the court below will be at liberty to pass appropriate order including cancellation of bail bonds of the petitioner. The District Judge, Vaishali is directed to expedite the trial of all the cases in one court pending against the petitioner. The Superintendent of Police, Vaishali is also directed to cooperate in the disposal of the trial and sent a report of the trial within six months as directed by this Court. Let a copy of this order be communicated to District Judge, Vaishali and Superintendent of Police, Vaishali for its forthwith compliance (Sandeep Kumar, J) Ranjeet/- U T
