Petitioner seeks bail in a case registered under section 302/34 of the Indian Penal Code.

Petitioner is not named in the first information report but it would appear from perusal of the impugned order that in course of investigation, he was arrested and made his confessional statement accepting his involvement in the present crime. However, it is submitted on behalf of the petitioner that petitioner and the informant are neighbours but even then the informant did not name the petitioner though he claims, himself, to be eye-witness of the alleged occurrence and apart from this, informant did not name the petitioner in his protest petition also.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on
