The petitioner seeks bail in connection with Excise Case No. 295 of 2018 instituted for the offence under Section(s) 30(a) of the Bihar Prohibition and Excise Act, 2016. It is alleged that from back side of the house of petitioner total 180 litres of foreign liquor has been recovered. Learned counsel for petitioner submits that recovery has not been made from conscious possession of this petitioner. The back side of the house of petitioner is an open place. Petitioner is in custody since 4.10.2018.

It is mentioned in para 3 of the bail petition that one another case under the Excise act is pending against this

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the learned 3rd Addl. Sessions Judgecum-Special Judge, Excise, Samastipur in connection with Excise Case No. 295 of 2018, subject to the condition that both the bailers shall be the close relative of the petitioner. The petitioner will file affidavit at the time of filing bail bond that he would not indulge himself in such type of activities in future. If he is found indulged in such type of activities, his bail bond in instant case will liable to be cancelled.
