JUSTICE MOHIT KUMAR SHAH ORAL ORDER 23-09-2022 Though the present writ petition has been filed seeking to challenge the notice dated 05.02.2021, issued by the Circle Officer, Suryagadha, Lakhisarai i.e. the respondent no. 5, however, at the outset, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to file objections/ show cause reply to the said show cause notice dated 05.02.2021, but seeks some protection, in the meantime.
Having regard to the facts and circumstances of the case, I deem it fit and appropriate to dispose off the present writ petition with liberty to the petitioner to file appropriate objections/ show cause reply, within a period of four weeks from today and in
Patna High Court CWJC No.10098 of 2021(2) dt.23-09-2022 2/2 case the same is filed, the respondent no. 5 shall consider the same and pass final orders under Section 6(1) of the Bihar Public Land Encroachment Act, 1956, within a period of 12 weeks, thereafter. It is needless to state that for a period of 16 weeks from today, status quo existing as on today, shall be maintained.
