Petitioner seeks bail in a case registered for the offences punishable under Sections 304(B)/34 of the Indian Penal Code.
Petitioner happens to be husband of the deceased, who died within three years of her marriage in other than normal circumstances. The post mortem report goes to show that cause of death was strangulation. There is allegation of illegal demand as well as torturing.
Therefore, considering the aforesaid facts and
Patna High Court Cr.Misc. No.46044 of 2016 (4) dt.13-01-2017 2/2 circumstances as well as submissions of the parties, I am not inclined to release the petitioner on bail, at least, at this stage and hence, his prayer for bail in connection with Chhabilapur P.S. Case No. 28 of 2016 pending in the court of Chief Judicial Magistrate, Nalanda at Biharsharif stands rejected. However, petitioner may renew his prayer for bail after six months, if his trial is not concluded within the above stated period.
