JUSTICE DINESH KUMAR SINGH ORAL ORDER 24-09-2015 Heard learned counsels for the petitioner and the State. The petitioner being the brother of the husband of the informant is apprehending arrest in a case registered for the offences punishable under Sections 498A, 354A, 341 and 323/34 of the Indian Penal Code.
The basic accusation is of torture. It is further alleged that the petitioner and husband of the informant made assault and outraged the modesty of the informant.
It is submitted by learned counsel for the petitioner that date of accusations of assault and outraging the modesty in the FIR has been mentioned as 25th of June, 2015 at 7PM and in the mid night written but report was submitted on 25.06.2015 itself. It is further submitted that frivolous accusation has been levelled by the informant to put pressure on the husband of the informant and

Considering the thrust of accusation against the husband of the informant, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned J.M., 1st Class, Patna in connection with Shastrinagar P.S. Case No. 348 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
