JUSTICE ASHUTOSH KUMAR ORAL ORDER 20-12-2018 The petitioner seeks bail in anticipation of his arrest in connection with Araria (R.S.) P.S. Case No. 30 of 2018 dated 21.01.2018 instituted for the offences under Sections 395, 412 of the Indian Penal Code.

After some arguments, Mr. Anil Prasad Singh, learned counsel for the petitioner seeks permission to withdraw the present petition in order to enable the petitioner to surrender before the Court below and seek regular bail.

Should such an application be filed before the Court below within a period of four weeks from today, learned Court below shall look into the totality of the

Patna High Court Cr.Misc. No.72666 of 2018(2) dt.20-12-2018 2/2 circumstances and pass orders without being prejudiced to the fact that the present anticipatory bail petition has not been entertained by this Court.

The petition is dismissed as withdrawn with the liberty aforesaid.
