The petitioner is apprehending her arrest in connection with Andar (M.H. Nagar) P.S. Case No. 173 of 2014 lodged for the offences punishable under Sections 341, 323, 504 and 304B/34 of the Indian Penal Code.

It has been submitted on behalf of the petitioner that petitioner is mother-in-law of the deceased and in this case earlier final form has been submitted finding case not true against the petitioner but later on cognizance has been taken against the petitioner also. It has further been submitted that during the course of investigation no witness has supported the prosecution case. However, later on viscera report shows poisonous substance was there in the body and there is no allegation against the petitioner that she administered poison to the deceased, rather there is

Having heard both sides and considering the fact that earlier the case was not found true and petitioner is a lady, let the petitioner, above named, in the event of her arrest or surrender in the court within a period of two weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the the Chief Judicial Magistrate, Purnea, in connection with Andar (M.H. Nagar) P.S. Case No. 173 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further conditions that petitioner shall co-operate in the investigation and make herself available before the police as and when required and in the event of failure on her part to appear before the police on two consecutive dates, the prosecution shall be free to move for cancellation of her bail bonds and further petitioner will not induce any witness or tamper with the evidence.
