Petitioner seeks bail in Pranpur P.S. Case No.61 of 2018 instituted for the offence under Section(s) 302/34 Indian Penal Code pending in the Court of the Additional District Judge-III, Katihar.

It is alleged that on the date of occurrence husband of the informant was brutally assaulted by this petitioner along with other accused, namely, Balram Paswan and Kashi Devi with Khanti, Fatta etc. on account of which he sustained serious bleeding injuries. He was taken to hospital where he died during course of treatment. Cause of occurrence is land dispute between the parties.

Case diary has been received, wherein, postmortem

Patna High Court CR. MISC. No.21578 of 2019(4) dt.01-08-2019 2/2 report is available. Doctor has found several injuries on person of the deceased.

Learned APP has submitted that the witnesses in para 8, 9, 10, 11 and 12 have supported the allegation as mentioned in the written report.

Therefore, this Court is not inclined to enlarge the petitioner on bail.

Prayer of the petitioner for grant of bail is rejected at this stage.
