Considering that in similar circumstance, based on similar set of facts, a Bench of this Court in the case of M/s Jai Mata Di Rice Mill & ors. v. the State of Bihar & ors., reported in 2015(4) BBCJ 335, has refused to quash the First Information Report after holding that on the basis of allegations in the First Information Report cognizable offences are made out, I am not inclined to entertain this application filed under section 482 of the Code of Criminal Procedure, 1973, seeking quashing of F.I.R. of Madhepura P.S.Case No. 105/2013.
In my view the present case is squarely covered by the said decision of this Court in the case of M/s Jai Mata Di Rice Mill (supra).
Learned counsel for the petitioner submits that the
Patna High Court Cr.Misc. No.40061 of 2013 (3) dt.17-03-2016 petitioner is an old man and he is facing undue harassment because of long undue pendency of investigation, for the last three years.
Considering the said submission, I direct the Superintendent of Police, Madhepura to ensure completion of investigation as expeditiously as possible.
With the aforesaid direction, this application stands disposed of.
