Petitioner is languishing in judicial custody since 01.11.2016 in connection with K. Nagar (Srinagar) P.S. Case No. 398 of 2016 registered for the offence punishable under Section 272, 273 of the Indian Penal Code and 30(a) of Bihar Prohibition and Excise Act, 2016.

The prosecution case as alleged by the informant is that on secret information the police personnel reached the shop of the petitioner and found 10 liters of country made wine in the shop. It has been submitted by learned counsel for the petitioner that he is innocent and has got no criminal history and nothing has been recovered from his conscious possession.

Be that as it may, considering the facts and circumstances of the case, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Purnea in connection with K.Nagar (Srinagar) P.S. Case No. 398 2016.
