The petitioners apprehend their arrest in Sour Bazar P.S. Case No. 226 of 2014, registered for the offences punishable under Section 307 and other Sections of the Indian Penal Code. Sudhir Kumar the informant alleged that while he was in the premises of a temple Vakil Yadav, Santosh Yadav, Pramod Yadav and Mithilesh Yadav having armed with sticks and iron rods came. Pramod Yadav is alleged to have assaulted the informant with Pharsa which hit on the hand of the informant. Vakil Yadav is alleged to have assaulted Ramratan Kumar on his head.

It is submitted that wife of the petitioner Vakil Yadav

Patna High Court Cr.Misc. No.365 of 2015 (2) dt.08-01-2015 filed Sour Bazar P.S. Case No. 229 of 2014, alleging therein that all the accused persons came and assaulted her making allegation against her to be witch. The injuries received by the informant and another are simple in nature.

Having considered the facts aforesaid and the fact that there is case and counter case and the injuries received by the informant and another are simple in nature, the petitioners, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saharsa in connection with Sour Bazar P.S. Case No. 226 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
