The petitioner is in custody in connection with Paroo P.S. Case No. 450 of 2018 for the offence under Section 457,380 and 34 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. Learned counsel for the petitioner submits that petitioner along with his companion was allegedly involved in theft in the house of the complainant Devendra Rai. Allegation against this petitioner is that inmates of the house of the complainant raised alarm and thereafter on chase this petitioner and in the light of the torch they identified the petitioner and co-accused Sanjit Kumar @ Laloo. Patna High Court CR. MISC. No.21557 of 2019(2) dt.05-04-2019 2/2 counsel for the petitioner submits that petitioner is a student of class B.Sc. (Hons.) in B.R. Ambedkar Bihar University, Muzaffarpur. He submits that petitioner is in custody since 29.12.2018.
Considering the fact that the petitioner has no criminal antecedent and he has remained in custody for more than 3 months, let the petitioner named above, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, 3rd (West), Muzaffarpur in connection with G.R. No. 4070 of 2018, arising out of Paroo P.S. Case No. 450 of 2018.
