Petitioner being the husband of the informant is languishing in custody since 09.09.2016 in a case registered for the offences punishable under Sections 498A, 307 of the Indian Penal Code and 3/4 of the Dowry Prohibition Act.
The basic accusation is of torture for nonfulfillment of dowry demand and making attempt to kill the informant.
The petitioner was granted provisional anticipatory bail vide Cr. Misc. No. 32865 of 2015 for a period of one year on the undertaking that the petitioner will keep the informant as wife with full dignity and honour.
Patna High Court Cr.Misc. No.44230 of 2016 (2) dt.24-10-2016 However, it is jointly submitted that now both the informant and petitioner are ready to resolve the issue on the terms of payment of permanent alimony of Rs. 17,00,000/-. The said amount will be paid within a period of six months. Both sides agree to file Matrimonial Suit under Section 13B before the Principal Judge, Family Court, Patna within a period of four weeks. Though, no joint application to that effect has been filed in the petition.
Considering the present stand of the parties, let the above named petitioner, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-VII, Danapur, Patna in connection with Danapur P.S. Case No. 644 of 2014.
Both the parties are at liberty to file a joint application before the learned court below reflecting their present stand within a period of three weeks. (Dinesh Kumar Singh, J) P.K./- U T
