The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 406, 420, 409/34 of the Indian Penal Code.

As per the prosecution case, this petitioner misappropriated government money of Rs. 23,14,925/- which was provided under Mukhyamantri Sat Nishchay Nal Jal Yojana.

It is submitted that petitioner is innocent and has committed no offence. Petitioner did not put his signature in the withdrawal form. He has been falsely implicated in this case and bears no criminal antecedent.

Counsel for State opposed the prayer for bail and submitted that petitioner is named in the FIR and there is

Patna High Court CR. MISC. No.23514 of 2023(2) dt.26-06-2023 2/2 allegation of defalcation of huge government money against the petitioner being Ward Secretary along with others. Considering the nature of accusation, I am not inclined to enlarge the petitioner above-named on anticipatory bail in connection with Sanhaula P.S. Case No. 189 of 2022. Accordingly, the same is rejected.
