Earlier, the bail application of the petitioner was rejected by this Court vide order dated 15.01.2024. in Cr. Misc. No. 79633 of 2023.
This is an application for grant of regular bail on behalf of the petitioner in connection with Muffasil P.S. Case. No. 96 of 2023 for the offence under Sections 25(1-b)a, 26(ii) and 35 of the Arms Act.
Learned counsel for the petitioner submitted that Interlocutory Application has been filed bringing on record that petitioner is suffering from cancer and in para-4 of the I.A. it is mentioned that the health condition of the petitioner fall down
Patna High Court CR. MISC. No.26366 of 2024(2) dt.26-04-2024 2/2 day by day. The doctors of the IGIMS and PMCH have clearly stated that the treatment of the petitioner is not available at these hospitals. Moreover, the petitioner is languishing in judicial custody since 27.09.2023.
Having heard learned counsel for the parties and considering the fact that petitioner is suffering from deadly disease, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail after framing of charge if the charge is not framed in connection with Muffasil P.S. Case No. 96 of 2023 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Munger.
