JUSTICE RAKESH KUMAR ORAL ORDER 17-01-2017 Heard Sri Ram Prawesh Kumar, learned counsel for the petitioner and Sri Amar Nath Jha, learned counsel who has appeared on behalf of the opposite party / husband of the petitioner.

The petitioner has made a prayer for directing for transferring Matrimonial Case No. 108 of 2013 from the court of Principal Judge, Family Court, Khagariya to the court of Principal Judge , Family Court, Purnea.

Learned counsel for the petitioner submits that petitioner is a lady and due to this reason it is difficult for her to regularly attend proceeding at Khagariya whereas learned counsel appearing on behalf of the opposite party submits that the

Patna High Court MJC No.4895 of 2013 (4) dt.17-01-2017 2/2 petitioner had herself left the her matrimonial house and this was the reason that the husband / opposite party filed a petition under Section 9 of the Hindu Marriage Act, 1955 for restitution of conjugal life.

Keeping in view the fact that the petitioner has sought for transferring the record in case of restitution of conjugal life there is no reason to entertain the petition. The petition stands dismissed.
