02-01-2019 Heard Mr. Sheikh Arkan Ahmad, learned counsel for the petitioner and Sri Lakshmi Kant Sharma, learned Addl. Public Prosecutor.

This is the 2nd attempt for grant of bail on behalf of the petitioner. Earlier, on 25-06-2018, vide Cr. Misc. No. 33938 of 2018, the prayer for bail of this petitioner was rejected with observation that the Court was not inclined to grant bail for the present. The petitioner is in custody since 24-02-2018 in Mufassil P.S. Case No. 57 of 2018 registered for offence under Sections 458, 382, 411 of the Indian Penal Code. Learned counsel for the petitioner submits that since in similar circumstance, after rejection of prayer for bail of this petitioner, another co-accused namely Vishal Kumar @ Visal Kumar has been granted bail, vide Cr. Misc. No. 50548 of 2018

Patna High Court Cr.Misc. No.74135 of 2018(2) dt.02-01-2019 2/2 on 14-09-2018 (Annexure - 3 to the petition), the petitioner may also be enlarged on bail. As per instruction, learned counsel for the petitioner submits that till date charge has not been framed. Learned Addl. Public Prosecutor has opposed the prayer for bail.

However, considering the fact that after rejection of prayer for bail of this petitioner, another co-accused has been granted bail as well as nature of accusation and period of custody, let the petitioner namely Thanthan Rawani @ Tan Tan Rawani be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Muffasil P.S.
