JUSTICE DINESH KUMAR SINGH ORAL ORDER 06-11-2015 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 406, 420, 467, 468, 120B of the Indian Penal Code.
The prosecution case is that 18 accused persons including the petitioner were employee of Kulkatta Power Industries Limited at Vaishali. Co-accused Sahjahan Khan was the Chief Managing Director whereas other accused persons were Directors of the said company. It is specifically alleged that co-accused Chandan Kumar persuaded the informant for investment in the said company. Subsequently the informant and others invested Rs. 20,00,000/- in the said company in the year 2011 but the company got closed in the year 2014. The petitioner is brother-in-law of co-accused Chandan Kumar who persuaded the informant to invest in the company.
Patna High Court Cr.Misc. No.49758 of 2015 (2) dt.06-11-2015 2/2 It is submitted by learned counsel for the petitioner that there is nothing on record to suggest that money was given to the petitioner. The investment was made in the company on the persuasion of co-accused Chandan Kumar who has been granted bail vide Cr. Misc. No. 32979 of 2015. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Hajipur Town P.S. Case No. 990 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
