This is a petition for grant of regular bail for offence under Sections 147, 148, 149, 323, 448, 452, 366, 504 and 34 and 27 of the Arms Act.

According to first information report, the petitioners and others, on the point of fire arm, took away to the daughter of the informant, i.e., victim, Puja Kumari. Puja Kumari, in her statement under Section 164 of the Criminal Procedure Code, stated that Mritunjay Chaudhary had committed rape against her and he had kept her for thirteen months. She gave birth to a female child from Mritunjay Chaudhary though she had already married with some other person. The petitioners were also present, but, there is no other allegation against the petitioners. The petitioners are in custody since 11.08.2016. Considering the facts and circumstances of the case, the petitioners, above named, are directed to be released on bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) each with two sureties of the like amount each in connection with

Patna High Court Cr.Misc. No.962 of 2017 (3) dt.14-02-2017 2/2 Kharik P.S. Case No. 198 of 2015 to the satisfaction of the Additional Chief Judicial Magistrate, Naugachia, Bhagalpur, or successor Court.
