JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 20-03-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Akorhigola P.S. Case No. 72 of 2016, registered under Section 498(A)/34 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act.

The accusation is of torturing the informant by her husband and in-laws due to non-fulfillment of demand of dowry and driven out from her matrimonial house.

Learned counsel for the petitioner submits that while petitioner is ready to keep his wife-opposite party no. 2 with full dignity and honour but his wife-opposite party no. 2 is not ready to

In fact, opposite party no.2, wife of the petitioner, was present at the time of disposal of prayer for anticipatory bail of the petitioner in the court of Sessions Judge, Rohtas, on 10.11.2017, and on that day she refused to live with this petitioner with making false allegation to perform the remarriage by this petitioner but this fact has not been stated by the opposite party no. 2 in her written report.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, Dehri, Rohtas, in connection with Akorhigola P.S. Case No. 72 of 2016, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
