JUSTICE ANIL KUMAR UPADHYAY ORAL JUDGMENT Date : 03-07-2020 Heard learned counsel appearing on behalf of the petitioners and learned counsel appearing on behalf of the State. The petitioners are aggrieved by the action of the respondents in arbitrary distribution of marks for appointment to the post of Special Survey Assistant Settlement Officer. Learned counsel for the petitioners submits that the petitioners' names are not in the final merit list only because of discrimination in award of marks for experience, the petitioners have been put down in the order of merit. Learned counsel submits that the petitioners have filed representations as

Patna High Court CWJC No.7005 of 2020 dt.03-07-2020 2/2 contained in Annexure-6 series which are pending before the Principal Secretary, Revenue and Land Reforms Department, Government of Bihar, Patna (respondent no. 1). Considering the fact that the representations are pending before the Principal Secretary, Revenue and Land Reforms Department, Government of Bihar, Patna (respondent no.1) since 23.01.2020, the writ petition is disposed of with a direction to the Principal Secretary, Revenue and Land Reforms Department, Government of Bihar, Patna to appropriately decide the representations and dispose of the same by a speaking order at the earliest preferably within a period of fifteen days from the date of receipt/production of a copy of this order. In the event position of the petitioners improves on account of revision of marks, the petitioners should be granted appropriate consequential reliefs.

With the aforesaid observation and direction, the present writ petition stands disposed of.
