2. Petitioner apprehends arrest in a case registered for the offence punishable under section 354 of the Indian Penal Code.
3. As per the prosecution case, this petitioner called the informant in his Mill and closed the door and committed rape and also threatened her not to disclose this ordeal to anyone.
4. It is submitted that after completion of investigation I.O. has submitted final form and found the case false against the petitioner. It is further submitted that on protest petition, the cognizance was taken under section 354 of I.P.C.
Patna High Court CR. MISC. No.24878 of 2023(3) dt.28-07-2023 2/2 against the petitioner.
5. Learned counsel for the State opposes the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Learned S.D.J.M. Saran at Chapra in connection with Complaint Case No . 1949 of 2016, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
