Petitioner seeks bail in Jay Nagar P.S. Case No.430 of 2018 instituted for the offence under Section(s) 379 Indian Penal Code.
Counsel for the petitioner submits that petitioner is not named in the written report. There is no recovery from possession of the petitioner. Petitioner has been made accused in this case by the police only on the plea that motorcycle has been recovered on the basis of confession of this petitioner, but no seizure list has been prepared by the police with regard to recovery of stolen motorcycle.
In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner,
Patna High Court Cr.Misc. No.77424 of 2018(2) dt.15-01-2019 2/2 above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Sessions Judge, Madhubani, in connection with Jay Nagar P.S. Case No.430 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
