Petitioner seeks bail in a case registered for the offences punishable under Section 366 A of the Indian Penal Code.

Petitioner is not named in the first information report but in course of investigation, petitioner and F.I.R. named accused, Md. Ali Raja along with victim were caught by the police at Motipur Railway Station. After that statement of victim was recorded under Section 164 of the Cr.P.C. in which she stated that she was forcibly taken away by the petitioner and F.I.R. named accused, Md. Ali Raja to Delhi and thereafter at the direction of F.I.R. named accused, Md. Ali Raja, she was brought back to

Patna High Court Cr.Misc. No.38447 of 2016 (3) dt.11-11-2016 2/2 Motihari by the petitioner and while they were standing at Motipur Railway Station, they were caught by the police. The victim has nowhere made any complaint regarding her sexual harassment. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Amit Kumar Tiwary, Judicial Magistrate 1st Class, Muzaffarpur in connection with Baruraj P.S.
