2. The petitioner seeks bail in connection with Piprakothi P.S. Case No. 63 of 2023 registered for the offence punishable under Sections 399, 402, 120-B of the Indian Penal Code and Sections 25(1-D) 25 [1-(1-A)], 25(1-AA), 26, 35 of the Arms Act.
3. As per the prosecution case, criminals had assembled to plan a loot. One country made pistol and one live cartridge was recovered from one Kunal Kumar Singh. Petitioner is one of the criminals who is said to have fled away from the spot when the police raided.
4. The learned counsel for the petitioner submits that

He further submits that petitioner will give an undertaking in the Court below that he will not involve himself in any criminal case after being released on bail. Learned counsel for the petitioner further submits that the petitioner will not stay in Bihar and he will stay in Himanchal Pradesh.
5. The learned APP for the State has vehemently opposed the bail application of the petitioner.
6. Considering the facts and circumstances of the case, this application is allowed.
7. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, East Champaran at Motihari in connection with Piprakothi P.S. Case No. 63 of 2023.
8. The petitioner after grant of bail will stay at the following addressVillage :- Bila Wali, Labana Police Station :- Baddi, District :- Solan Pin Code :- 173205 State :- Himanchal Pradesh
9. The petitioner will also mark his attendance at the Baddi Police Station, Solan, Himanchal Pradesh on the first and
Patna High Court CR. MISC. No.24358 of 2024(3) dt.06-09-2024 3/3 third Sunday of each month. Any default in appearance at the Police Station would be result in cancellation of bail bonds of the petitioner.
10. The petitioner will visit Bihar only on the date fixed in the trial Court in which he is an accused and is required to visit the Court. Before leaving State of Himanchal Pradesh, the petitioner will inform the local police station about the case and the date and the period for which he is going to stay in Bihar to attend the cases.
11. Let a copy of this order be communicated to the Senior Superintendent of Police / Superintendent of Police, Solan, Himanchal Pradesh through FAX for its compliance forthwith.
