The present petition has been preferred for quashing of the order dated 27.08.2015 passed in S.T. No. 99/2015/10/2015 arising out Kauwakol P.S. Case No. 145/2012 passed by learned Additional and Session Judge IVth Nawada whereby the learned Judge dismissed petition dated 29.06.2015 filed under Section 227 of Cr.P.C.

As per the prosecution story, the informant alleged that his daughter Lakshmi Kumari was married to Subodh Singh (the petitioner herein) in the year 2009 but was tortured for dowry and in 2012 when he went to see his daughter, found her senseless on the bed. She was carried out for the treatment but

Patna High Court CR. MISC. No.45750 of 2015(2) dt.15-03-2023 2/2 died on way allegedly due to administration of poison. Accordingly, the F.I.R.

The police investigated the matter and submitted charge-sheet whereafter the learned Court took cognizance under Section 306 I.P.C. and 3⁄4 of the Dowry Prohibition Act. Thereafter, the discharge petition was preferred which came to be rejected on 27.08.2015 vide a reasoned order after incorporating the postmortem report as also the paras of case diary.

This Court does not find any merit and/or any justification to interfere in the matter.

The petition stands dismissed.
