This is an application seeking withdrawal of the application with respect to petitioner no. 1, Md. Ali, who was granted bail vide order dated 14.11.2014 passed in Cr. Misc. No. 26673 of 2014, in connection with Mirganj P.S. Case No.63 of 2014, pending before the Chief Judicial Magistrate, Gopalganj.

It is submitted that though the above petitioner apprehended but due to pressure of work, learned counsel at the time of submissions failed to make due submissions but argued the case of the petitioner also along with co-petitioners. For such error, the above petitioner has already suffered substantial detention since his prayer of regular bail has been refused by the court below on that ground alone. Taking into consideration the facts and circumstances and extra detention of the petitioner, the order dated 14.11.2014 passed in Cr. Misc. No. 26673 of 2014 to be treated modified to the extent that the same is withdrawn with respect to the above named petitioner. (Akhilesh Chandra, J) Ashwini/- U T
