Petitioner is languishing in custody since 16.10.2016 in connection with Shahpur P.S. Case No. 259 of 2016 for the offences punishable under Sections 457/380 of the Indian Penal Code.

Some unknown person committed theft in the house of the informant and removed gas cylinder; whereas in the same night mobile phone of the neighbours was also stolen away.

Submission of the petitioner is that none of the stolen property was recovered from the house of the petitioner nor

Patna High Court Cr.Misc. No.51765 of 2016 (2) dt.30-11-2016 2/2 there is any eyewitness of the occurrence. The petitioner has stated on oath that he has got no criminal antecedent. Considering the facts and circumstances, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial MagistrateXIV, Ara, in connection with Shahpur P.S.
