The petitioners, Pradeep Tanti, Anandi Tanti and Dilip Tanti, apprehend their arrest in Sikandra P.S. Case No.57 of 2014, registered under Section 307 and other sections of the Indian Penal Code and Section 27 of the Arms Act. Ram Chandra Tanti alleged that while he was constructing the house, all the accused persons came and assaulted him with different weapons.

Learned counsel for the petitioners submits that the date of occurrence is 04.06.2013, but Ram Chandra Tanti filed complaint case on 12.06.2013, on the basis of which, the present first information report was lodged. On the same day, Anandi Tanti filed a case bearing Sikandra P.S. Case No.183 of 2013.

Patna High Court Cr.Misc. No.52211 of 2014 (2) dt.06-01-2015 2/2 Anandi Tanti received head injury. It is submitted that the present case is counterblast and Ram Chandra Tanti got lacerated would on his head, which are opined to be simple in nature. Perused the record.

It appears that there is a case and counter case, but the informant of the present case lodged the complaint case after a week from the date of occurrence. The informant received simple injury.

Having considered the aforesaid facts, the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Jamui, in connection with Sikandra P.S. Case No.57 of 2014, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
