JUSTICE RAKESH KUMAR ORAL ORDER 04-10-2016 Heard Sri Sudhir Kumar Sinha, learned counsel for the petitioner and Sri Anant Kumar, learned Additional Public Prosecutor.

The sole petitioner, who is in custody since 30.6.2016 in Barachatti P.S. Case No. 204 of 2016, registered for the offence under Section 272, 273 of the Indian Penal Code and Section 47(a) of the Bihar Excise (Amendment) Act, 2016 has prayed for grant of bail.

It was submitted by learned counsel for the petitioner that petitioner is having clean antecedent and this fact has been mentioned in paragraph no. 3 of the petition. He submits that on false accusation of recovery of about 32 liters country made liquor petitioner has been arrested and he is languishing in jail.

Patna High Court Cr.Misc. No.40633 of 2016 (2) dt.04-10-2016 2/2 Keeping in view the nature of accusation, period of custody and antecedent of the petitioner, let the petitioner Sanjay Sao be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand ) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Sherghati at Gaya / concerned court in connection with Barachatti P.S. Case No. 204 of 2016.
