The petitioner is in custody since 22.03.2018 in connection with Deepnagar P.S. Case No. 93 of 2018 for the offence registered under Sections 302/34 of the Indian Penal Code.

Learned Senior Counsel appearing on behalf of the petitioner submits that the prayer for bail of the present petitioner was earlier rejected vide order dated 19.07.2018 passed in Cr. Misc. No. 37457 of 2018 but in view of the changed circumstances, the petitioner is again renewing his prayer for bail. It is further submitted that one co-accused, namely, Yogi Yadav @ Yogiya Yadav @ Yogi @ Yogendra Yadav, against whom there is similar allegation of having caught

Patna High Court CR. MISC. No.72568 of 2018(2) dt.29-03-2019 2/3 hold of the deceased, has since been extended the privilege of bail in Cr. Misc. No. 63506 of 2018 vide order dated dated 06.11.2018.

Considering the aforesaid facts and circumstances of the case and in view of the fact that similarly situated coaccused namely, Yogi Yadav @ Yogiya Yadav @ Yogi @ Yogendra Yadav has since been granted bail, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of A.D.J. VIIth, Nalanda at Biharsharif in connection with Deepnagar P.S. Case No. 93 of 2018, subject to the following conditions:-

1. One of the bailors will be his own blood relative, preferably, father, mother, son, brother, sister and/or his wife.

2. The petitioner shall not indulge himself in any similar offence till conclusion of the trial.

3. The petitioner shall remain physically present in court on each and every date during trial and in the event of his failure on two consecutive dates without sufficient reasons, his bail bonds shall be liable to be cancelled by the learned court concerned.

4. The petitioner shall co-operate with the
