The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 363 & 364A of the Indian Penal Code.
As per prosecution case, the informant alleged that his son namely Akshay Kumar was gone missing on 15.1.2023 while he was going to Nawada. Thereafter, the informant lodged this case regarding abduction of his son.
Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. The prosecution case lodged against unknown and the petitioner has falsely been implicated in this case on the basis of his self confessional statement. The victim/son of the informant was
Patna High Court CR. MISC. No.24926 of 2023(3) dt.24-07-2023 2/2 recovered and his statement has been recorded u/s 164 of Cr.P.C. but he has not disclosed the name of the petitioner. It is also submitted that the abduction of informant's son was committed in the background of ransom demand but the same has not been executed. During course of investigation, no any consistent material has come against the petitioner. Moreover, he has got no criminal antecedent and languishing in judicial custody since 21.1.2023.
Learned APP appearing for the state has opposed the prayer of regular bail.
Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Pakaribarawan P.S. Case No. 16 of 2023 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Nawada.
