JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 25-10-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-379/411 of the Indian Penal Code.

Taking into consideration that the petitioner was caught with stolen attachee just after the alleged occurrence, I am not inclined to release the petitioner on bail and accordingly, his prayer for bail in connection with Chapra Rail P.S. Case No. 39 of 2016 stands rejected.

However, if, trial of the petitioner is not concluded within four months, the petitioner may renew his prayer for bail before the learned trial court itself.
