The prosecution case in brief is that 155 bottles of foreign liquor were recovered from the motorcycle and a case has been registered under Sections 272/273 of the Indian Penal Code and Sections 47(A), 47(G) of the Excise Act.

It has been submitted on behalf of the petitioner that the said article has not been recovered from the possession of the petitioner rather from the motorcycle. The petitioner is in custody since 14.9.2016 and another co-accused has been granted bail by a Bench of this Court in Cr.Misc.No. 50544 of 2016.
