JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 02-05-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with P.S. Case No. Vijaipur P.S. Case No. 151 of 2013 registered under Sections 147, 148, 149, 332, 333, 307, 337, 338, 427, 397 and 109 of the Indian Penal Code.

The accusation is that on 24.09.2013 the members of Male were sitting on Dharna in relation to Vijaipur P.S. Case No. 151 of 2013 and at that time they entered in the Office of Circle Officer by breaking the door and assaulted him and also damaged the furniture and papers etc. The police came in the office of Circle Officer to rescue him but they were also assaulted by the mob. In this connection, 56 persons including the petitioner were

Patna High Court Cr.Misc. No.13439 of 2017 (2) dt.02-05-2017 2/2 named in the FIR were identified by the Choukidar. Submission is that while petitioner is name in the FIR but no overt act has been instituted against him. The petitioner has no criminal antecedent. Further submission is that similarly situated co-accused Manager Yadav and others have already been granted anticipatory bail by a coordinate Bench of this court passed in Cr. Misc. No. 38431 of 2016 vide order dated 21.09.2015.

Considering the aforesaid submissions, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Learned Judicial Magistrate-1st Class, Gopalganj, in connection with Vijaypur P.S. Case No. 151 of 2013, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
