JUSTICE RAKESH KUMAR ORAL ORDER 16-01-2017 Heard Sri Nirmal Kumar Shrivastava, learned counsel for the petitioner and learned A.C. to Govt. Pleader - 22. The present petition has been filed with a prayer to restore C.W.J.C. No. 11271 of 2010, which stood dismissed on 17-11-2011 due to non-prosecution.

Learned counsel for the petitioner, by way of referring to averment made in the present petition as well as medical certificates, which has been brought on record, submits that learned counsel himself was suffering with certain ailments and this was the reason for his non-appearance.

After hearing learned counsel for the parties and considering the ground set-forth in the petition, same is allowed. Let C.W.J.C. No. 11271 of 2010 be restored to its original file.
