JUSTICE SUDHIR SINGH ORAL ORDER 27-01-2016 Heard learned counsel for the petitioners and learned counsel for the State The petitioners are apprehending their arrest in connection with Tatarpur (University) P.S. Case No. 47 of 2015 pending in the Court of CJM, Bhagalpur for the offences instituted under Sections 420, 467, 465, 466, 468 and 471 of the Indian Penal Code.

Patna High Court Cr.Misc. No.45065 of 2015 (3) dt.27-01-2016 The prosecution case in short is that petitioners have filed Order No.230/97 Gyapank No.B/13320-50 dated 03.01.1997 as Annexure before the Hon'ble Court which is forged and fabricated document prepared by these petitioners. It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. Petitioners have been made accused due to mistake of fact. There is no direct or indirect evidence against these petitioners.

On behalf of the State, it has been submitted that the present case has been instituted by the Registrar of the University and fake documents were filed by the petitioners. Considering the aforesaid facts and circumstances of the case, I am not inclined to release the above named petitioners on anticipatory bail, the same is rejected.

Anyhow, if the petitioners surrender in the court below within a period of four weeks, the same shall be considered on its own merit without being prejudiced by this order. (Sudhir Singh, J) B.Kr./- U T
