The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 420 and 406 of the Indian Penal Code.

The prosecution case is that the petitioner has eight trucks and a brick kiln when the petitioner purchased diesel on credit from the petroleum dealership of the informant to the extent of rupees five lakhs sixty one thousand but he has not made the payment.

It is submitted by learned counsel for the petitioner that the petitioner has only two trucks and there is no proof that the diesel was supplied to the petitioner on credit.

Patna High Court Cr.Misc. No.43591 of 2015 (2) dt.14-10-2015 2/2 Though, the petitioner was accused in three other cases but he has been acquitted in all the cases and at present petitioner has no criminal antecedent.

Considering the nature of accusation arising out of contractual nature of relationship between the parties, let the above named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria in connection with Maheshkhut P.S. Case No. 100 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
